Terms and Conditions

Welcome to Magic All Ltd “Terms and Conditions”

The following is for the guidance of all Athletes, parents and guardians on behalf of the location/Coach that you have registered with.

 

 

These Terms and Conditions are issued for guidance purposes and any query should be relayed back to the Head Coach of your location.

 

Please read these terms and conditions as upon registering as a new athlete and/or account holder we “Magic Allstars” and “Your Coach/s” will recognise that you are happy with and understand these terms and conditions in joining and becoming a member of Magic Allstars Ltd and its locations.

These terms apply to all members who have joined Magic Allstars Ltd on an annual insurance basis, are paying training fee’s for Magic Allstars training sessions by means of a complimentary, pay per class, monthly or paid in full option and are subject to change without notification. we advise that you review these terms and conditions on a regular basis as they may be changed and updated from time to time.

1. Who We Are

Magic Allstars Ltd is the company responsible for the Brand known as “Magic Allstars Cheerleading” The Cheerleading Programme is owned and directed by Scott Rowlinson and Brenda Abraham who are focused on the growth and development of its Athletes, Coaches and helpers in Allstar Cheerleading.

2. Membership/Team joining fee

Your membership/Team joining fee will start from the date entered at the point of your registration by means of our online registration system if applicable, the date completed on any paper copy version of the registration form, completed from any marketing material or will taken from the date that a payment was recieved.

 

2.1

2.1a Your annual membership to a team or programme will expire at the end of the current training season year

2.1b Annual Memberhip/Team Joining fee will run for no longer than 1 year from the payment date or which ever come sooner from condition 2.1a

2.1c Annual memberhip/team joining fee cannot be tranfered between programmes

2.1d Following the expiration of your team memberhip/joining fee the athlete will be invited to attend try-outs to be placed to a new programme/team where a new joining fee will be applied

2.1e Cancellation or termination to your Magic Allstars team programme is not allowed and should only be made with the strict understanding of the commitment required for the new seasons teams

2.1f If the cancellation of your membership is received or requested NO Refunds will be issued.

2.1.1 Membership/joining fee types

Magic Allstars student memberships are charged as follows:

2.1.1a Seniors Annual Membership/joining fee age group 13+ (but not exclusive) Recreational training sessions

Seniors “annual” membership/joining fee meaning valid for 12 months or the current training season for Athletes aged generally 13+, if a parent or guardian wishes to place a younger student into the senior aged group who fall below the age of 13 and is accepted by Magic Allstars Cheerleading then the senior membership/joining fee will still be applicable.

Senior annual membership/joining fee is charged at £39.00 per annum (VAT Excluded where applicable). 

2.1.1b Junior Annual Membership/joining fee aged 7 to 12 years (but not exclusive) Recreational training sessions

Junior group “annual” membership/joining fee meaning valid for 12 months or the current training season for students aged generally 7 years old to 12 years old, if a parent or guardian wishes to place a younger or older student into the Junior aged sessions who fall below the age of 7 or above the age of 13 and is agreed by Magic Allstars, the Junior membership will still be applicable.

Junior annual membership/joining fee is charged at £39.00 per annum (VAT Exclusive where applicable).

2.1.1c Tini’s & Mini’s Annual Membership/joining fee aged 4 to 6 years (but not exclusive) Recreational training sessions

Tini’s and Mini’s “annual” membership/joining fee meaning valid for 12 months or the current training season for students aged generally 4 years old to 6 years old, if a parent or guardian wishes to place a younger or older student into the Tini’s or Mini’s aged classes and is agreed by Magic Allstars Cheerleading who fall below the age of 4 or above the age of 6 the  Tini/Mini’s membership/joining fee will still be applicable.

Tini’s and Mini’s annual membership is charged at £39.00 per annum (VAT exclusive where applicable).

 

2.2 Discounted Membership/Joining fee

2.2a The Annual membership/joining fee may from time to time be offered free of charge, or at a discounted rate, an eample of this may be “as a referral reward, a complimentary rate or a promotion to help the academy and sessions grow. Any discount offers are offered at the sole descretion of Magic Allstars Ltd and will be subsidised by the company.

2.2b The annual Membership/joining fee discounts, if offered to new members is not applicable to any other group, athlete or parent who may have joined previoulsy joined Magic Allstars Cheerleading and having paid a different rate.

2.3 Suspending, Cancelling or Transferring your membership/joining fee

2.3.1 Suspending your membership/joining fee

Your Athlete membership/joining fee cannot be suspended; membership is for a 12 month period from the date of activation and is different to a Athlete’s monthly training fee’s payment which may be cancelled at any time subject to the terms and conditions of the specific team or progamme that the Athlete is on, please refer to section 3.4 below for training fee cancellation.

2.3.2 Cancelling Your Membership/joining fee

2.3.2a If you wish to cancel your annual membership to a Magic Allstars programme/team, this can be done in writting to Magic Allstars Ltd and a verbal conversation be had with the head coach, The Athlete will be removed from the programme/team subject to the term and conditions of that programme/team.

2.3.3 Transferring your membership

2.3.3a Membership is individual to the Athlete who has been registered and cannot be transferred to any other Athlete, friend or family member.

2.3.4 Training with an expired membership

2.3.4a An Athletes Annual membershipjoining fee should be renewed on the day before its anniversary, Athlete’s with an inactive or expired membership are able to attend training sessions and must not attend classes

2.3.4b Athlete’s should not attend class with no active membership and make sure to speak to the Head Coach prior to any attendance in order to renew at the earliest time possible to avoid training disruption.

2.4 Our right to cancel your membership/joining fee

We may decide to cancel your membership/joining fee if:

2.4a You break any of these terms and conditions

2.4b You put the health, safety or well-being of other Athletes at risk

2.4c You put the health, safety or well-being of our Coaches at risk

2.4d You behave irresponsibly and violate our Training room rules and regulations

2.4e You engage in disruptive or violent behavior

2.4f You take action to bring the Company or cheerleading programme into disrepute

2.4g If you use abusive or threatening behavior towards a Coach or other Athete, this is deemed to be both inside the training environment and outside the training gym, and includes text messages, direct telephone calls and emails, Any behaviour deemed inappropriate will be actioned accordingly.

2.5h If repeated warnings are given to a Athlete regarding his or her verbal or Physical behaviour towards others then membership and training will be cancelled with immediate effect.

If we decide it is appropriate to cancel your membership/joining fee no refund is applicable.

3. Training fee’s and Programmes

 

3.1 Training Fees

3.1a Training fee’s are payable for all Athletes irrespective of which programme/team that they belong.

3.1b Training fee’s are due on the agreed date with the Magic Allstars Academy following the first complimentary session (If given) and should be paid on or before time, Magic Allstars should not be required to chase training fees for athletes

3.1c Training fees are not refundable and it is the Athlete/Parent-Guardians responsibility to cancel the payment to ensure that this is not made if the Athlete has stopped training.

3.1d Training fees are paid each month and hold the athletes place in the allocated programme/Team, non payment will result in the athletes place being immediatly released to others

3.1e Should the Athletes training fee be paid irrispective of notice given, refunds will not be issued and the athletes place will be held for that current month

 

3.2 Training fee Monthly payment

 

3.4.1 Suspending of monthly tuition

Suspension of your monthly training fees is at the sole discretion of the head coach and must be raised directly with them, if you stop any training fee payments without notification then a joining fee may be applied if you wish to rejoin the programme.

Training fees are not normally allowed to be suspended and athletes would under normal circumtances be asked to leave the programme as all sessions are normally restricted to a max athlete cap, Places will be filled following non payment of training fees and presumed the athlete has left the programme

3.4.2 Cancellation of training fee payments

3.4.2a If you wish to cancel your tuition payments it is requested that you inform the head coach directly, if you are looking to restart your training at a later point then a joining fee may be applied unless this has been agreed in writing at the time of cancellation.

3.4.2b It is the responsibility of the athlete/parent/Guardian to cancel any standing orders that have been set up for the training fee monthly payment, failure to do so will incur the monthly payment being made and refunds will not be issued..

3.4.2c If a reoccurring monthly payment has been set up by the athlete/parent/Guardian on a standing order or credit card through an online payment system it is the responsibility of  the athlete/parent/Guardian to cancel the payment with the bank or card issuer, cancellation cannot be requested directly to the coach and they cannot request for the payment to be cancelled with the bank or online payment collection service however, any request received for a payment that has been debited will not be refunded.

3.5 Transferring your tuition

3.5.1 Tuition payments cannot be transferred between athletes or family members, all payments made are for the individual athlete

3.3 Programme and training available

Magic Allstars Ltd has the following programmes and training scheduals available for Athletes to join however this is a guidline only and may change subject to athlete numbers and abilities:

3.3.1 Recreational Sessions (Adults and Children)

Recreational (REC) Sessions are an introductory programme only, and designed to give new and existing athletes a basic start and oveview of Allstar Cheerleading and an introduction to the Magic Allstar Cheerleading family. This programme will allow the athlete to gain an insight into all elements of cheerleading and set the goal of being placed onto a Allstar Cheerleading competitve team, it does not guarantee placement to a competitive team and athletes will be subject to Level 1 to Level 7 qualification and try-out’s to be placed

3.3.1.1 Recreational Programmes are charged at a single or double session per week.

3.3.1.2 Recreational sessions are set to 1 hour time slots however this may be changed at the decretion of the head coach from time to time.

3.3.2 Competition programmes (Children & Adults)

Competition programmes are designed to give the indivdual Athlete the skill and ability to compete at a high level at national and international competitions and work within a professional Cheerleading team

Training is designed to develop the athletes skills and ability to perform and win!

3.3.3 Tumble only Sessions

Tumble only sessions are available and designed to improve the athletes Tumble skills and abilities only, these sessions will drill down into the skill and help the athlete undertand what changes are required to help improve there ability and take that back into either there Recreational sessions or Team training

Tumble only sessions are open to all Athletes and the session will be split into level appropriate sections

3.3.4 Flyer only Sessions

Flyer only sessions are available and designed improve the athletes Air skills and abilities only, these sessions will drill down into the skill and help the athlete undertand what changes are required to help improve there ability and take that back into either there Recreational sessions or Team training

Flyer only sessions are open to all Athletes however it is advised to only book these sessions following discussions with the head coach to ensure that the athllete will be allowed to Fly due to size, weight and ability of the group and flyer, the session will be split into level appropriate sections

 

 

4. Levels, Testing fee’s & Certification

 

The Magic Allstars certification program enables Athletes to gain an inhouse understanding of there skill and ability within an Allstars cheerleading level process, Testing day and certificates are for Magic Allstar placement only and may not be accepted by other cheerleding programmes.

Magic Allstar Certification allows the Athletes to gain a sense of development for themselves so to help guide them in there Cheerleading journey for Athlete level appropriate placements

 

5. Uniform and Merchandise

The purchase of uniform is not compulsory for Recreational training sessions however it is advised and recommended that students take their new hobby/activity seriously and represent themselves and our brand/Programme accordingly, all uniform and merchandise can be purchased directly from your head coach or our website.

5.1 Athletes wishing to engage in Stunts and participating as a flyer are recommened to purchase the correct footwear from our approved supplier through Magic Allstars only.

5.1a Cheer shoes that are not purchased from us directly may not be accepted in Competition programme training for saftely purposes.

5.2 Under no circumstances is training kit from non Magic Allstars clubs allowed to be worn.

5.3 Athelets wishing to attend level certification days must be in full kit and will not be allowed to participate if unsuitable clothing is worn to the day

5.4 Training Kit must be clean and maintained in a smart and presentable manner at all times.

5.4 Foot wear must be clean and free from damage at all time, inappropriate footware or dirty shows will not be allowed on the training floor.

6. Academy Time tables and Training session times

Magic Allstars Ltd do their best to maintain a fully running timetable and class availability across its venues, the aim for each full time Coach is to provide full time Magic Allstars training sessions where possible.

6.1 In the event of a venue/academy being financially unviable the head Coach will take steps firstly to amend the situation where possible with the venue in question, if required the Head coach as a secondary measure may reduce the amount of classes available until the situation improves.

6.2 Cancellation of training sesssions may occur if all avenues to make a venue viable have not proved successful.

6.3 In the event that an academy/venue becomes financially unviable the head Coach may from time to time make the decision to close the location.

7. Insurance – This is simply an overview of Insurance

 

Magic Allstars Ltd offers the following insurance:

 7.1 Public Liability Insurance

7.1a Public Liabilty is for the purpose of insurance to property and any damage caused by our Athlete’s or customers to the properties that we use through there negligence.

7.1b Public Liability Insurance does not insure for reverse accident, where a injury occurs due to the property being unsafe or in a disrepair state. Where an accident happens due to the property this must be taken up with the property owner directly and action taken against the property owner/Public Liability insurance.

7.2 Professional Indemnity Insurance

 7.2a Professional Indemnity Insurance is in place for a claim arising againt negligence of a qualified coach for the direction or training that they are directly responible for, Any trainee or junior coache under the direct supervision of the Main Insured coach will be covered under the professional Indemnity Insurance policy held by that coach

7.2 b Professional Indemnity insurance will not and does not cover a claim arising from an athlete giving another athlete advise on training and Athletes should be mindful that it is not there responsibility and are not allowed to participate in giving training/coaching advise.

7.3 Employers Liability Insurance

 7.3a Magic Allstars maintains an employee Liability insurance policy, this is to insure all employees and coaches, Junior coaches who are directly under the supervision of the coach for an accident that may occur in a training session

7.3b Employee liability insurance does not cover non qualified coaches or junior coaches to coach on there own without the direct supervision of a fully qualified coach.

7.4 Athlete personal Injury cover

7.4a Athlete personal Injury inurance cover is not available directly through Magic Allstars Cheerleading and this injury cover can only be taken out for the person looking to be covered for injury directly

7.5 Athlete to athlete Insurance (Commonly known as member to member insurance)

7.5a Athlete to Athlete Insurance does not exist in Cheerleading and if the Athlete/Parent-Guardian is concerned about injury to the Athlete/Child then we would recommend Personal Accident Insurance to be taken out.

7.5b Athlete injury in a training session is covered for stunts that are directly under the supervision of the coach and comes under the professional Indemnity insurance of that Coach.

 

PLEASE BE AWARE

Insurance policies taken out by Magic Allstars is to cover Magic Allstars against its risk and liabilities, It is not possible for us to take out Insurance on the behalf of an indivdual and you cannot have insurance from someone else to cover your risk or Injury which has occured due to your personal actions or your personal liability

If you are in any doubt if you or your child is covered against loss, injury or liability please seek professional Insurance guidance and make sure to take out the correct insurance policy for your needs and requirements

Our Insurance does not cover some of the examples listed here:

– Missing training sessions

– Personal Injury to the athlete/child in the course of their training

– Injury caused to others through the negligence of the Athlete/Child in training (A clear example being if injury is caused to others by wearing False nails, Jewelry etc)

 

8. Saftey and Precautions

 

8.1 Jewellery

Jewellery of any kind is not permitted to be worn in any training sessions, any jewellery which is left in place for training MUST be removed prior to the start of the session.  It is against the competition rules for athletes to compete in any jewellery, so athletes need to remove this prior to going to warm up.

Sticking plasters/tape/wearing clear jewellery are NOT appropriate substitutes to this.

8.2 Footwear

Clean training shoes must be worn at all times when training for saftey purposes ensuring that these have good tread and are not damaged.

Foot wear such as:

Crocks, Shoes, Socks or barefeet are NOT Allowed

COMPETITION FOOTWEAR

All Athletes who wish to be part of or are apart of an Allstars Competition team must have competition training shoes, these are compulsory for competitions and no other footwear is permitted, Competition athletes in training may wear competition trainer variation (Cheaper versions) or normal clean and damage free training shoes however these must be used as a supplimentary set of shoes and will not be allowed under any circumstances be used when attending a competiton.

8.3 Finger Nails

Finger nails should be clean and free of dirt, Maintained in a presentable mannor and not able to cause injury to other athletes

Overlong fingernails are dangerous and must be kept trim before training and competitions, any athletes with artificial nails will NOT be allowed to train and are also against competition rules and the athlete will not be allowed to compete and therefore MUST NOT be worn.

 

8.4 Hair

 8.4.1 An Atheletes hair should be maintained in a clean and presentable mannor, preferably hair should be tied up and secure for training sessions so not to injury other athletes, Long hair to be tied up away from face and not with a clip as these can cause injury and hurt the wearer when tumbling, A Hair hand tie should be used

– Long hair MUST be tied up either in braid or braids / high ponytail as long as the athlete’s having to keep redoing their hair in their training sessions. Please ensure that there are NO headbands, decorative hair clips or pins or anything sharp.

8.4.2 Hair extentions, Athletes need to be aware that these may be at risk of being pulled (By Accident) in a training session. It is not unknown for athletes/Flyers to stumble, fall or being caught by others in a stunt in a way that could cause hair to be pulled or grabbed by mistake.

 

9. Your personal information

 

Magic Allstars Ltd take our responsibility to look after your personal information extremely seriously and you can find out how we use, store and delete the information that we hold about you on our Privacy Policy page or how to request the information that we hold on you by completing the Data Protection form. You may ask us to delete any information held about you at any time however if we are requested to delete any information that we hold about you this may affect your Insurance/membership and training with Magic Allstars Ltd.

It is your responsibility to keep Magic Allstars updated and to inform us about any changes to your personal information.

10. Our responsibility to you

 

10.1 Personal Belongings

Magic Allstars Ltd will try its best to offer secure storage for your personal belonging, however where this is not possible and when it is, It is still your responsibility to look after and care for you own personal belongings whilst attending any training sessions or venues and we advise that you do not leave any valuable items without supervision.

10.1.1 We are not responsible for any personal possessions that you bring to your sessions or tuition based environment classes.

10.1.2 If you lose any personal belongings please notify the Head Coach immediately so they can inform the venue in question or speak of other students of the class to investigate this loss.

10.1.3 It is not our responsibility if your personal belongings are damaged.

10.1.4 We are not liable if your personal belongings are stolen at a venue and we recommend that you report this incident to both the Head Coach, Venue and the relevant authorities immediately.

10.2 Accidents or injuries

If you have an accident or injure yourself at one of our classes you must report this to the Coach immediately and they must record this in an accident and emergency book with full details of the incident or injury, do not leave the premises before recording this information, please supply as much information as possible.

PLEASE MAKE SURE TO READ THE SECTION REGARDING INSURANCE

It is not possible for Magic Allstars to take out Insurance for an Athletes personal injury, this MUST and CAN ONLY be done by the Athlete or parent/Guardian of the Athlete for themselves.

 

11. Magic Allstars Brand Name and Use

The brand name of Magic Allstars Ltd and its subsidiary branding titles as detailed here are solely and exclusively owned by Magic Allstars Ltd, the use of these brand names are restricted to those authorised by the Managing directors in writing or under license by an authorised license agreement.

11.1 Unauthorised use of the brand name and/or logos will be requested to be removed.

11.2 Any unauthorised use of the brand name and logos that are not removed upon request may be pursued through legal means.

12. Changes to these terms and conditions

 

We may from time to time change and update these terms and conditions.

We will give you at least 30 days notice to inform you of any significant changes that may affect your membership via email communication however this may not be the case for small minor amendments, these may be announced through the Head Coach or in venue notifications

Please take the time to check and read these terms and conditions in order to check for any updates, read through our Academy rules and regulation policy, code of conduct policy and the privacy policy document as well as the Medical information policy that we have written to keep you safe within the classroom.

We may also publish the updated terms and conditions on our website.
